Prop 102 would deny punitive damages to exploited workers and give bad bosses a free pass to abuse undocumented immigrants.
About Proposition 102
Don't Give Abusive Employers a Free Pass
Punitive damages are awarded to victims. When a court funds evidence that an individual or corporation "acted with an evil mind, an evil heart and an evil hand" – the legal standard for awarding punitive damages – that person should be compensated. Proposition 102 seeks to protect individuals and corporations who mistreat victims by ensuring that they don't have to pay punitive damages if they are found guilty of abuse.
Proposition 102 gives abusers a free pass to victimize people in a consequence free environment. If abusers know that they will not be held accountable for inhospitable working conditions or inhumane treatment – they are much more likely to violate fundamental human rights.
Proposition 102 enshrines discrimination into Arizona's Constitution. It gives abusers a free pass to mistreat people knowing that they will not be held liable for any punitive damages. Arizona should not grant rights and protections to people that are guilty of abuse.
